    1. Acceptance of Terms

    By accessing or using Truck Driver Match ("the Platform" or "the Service"), operated by Driver Acquisition, LLC ("we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using our Services.

    2. Description of Services

    Truck Driver Match provides a recruitment and job-matching platform for commercial truck drivers and carrier partners. Our Services include an AI-powered chat system, human recruiter assistance, job matching, and related communications. Our Services are provided free of charge to drivers.

    3. Consent to Communications

    By using our Services and providing your contact information, you expressly consent to and authorize Truck Driver Match to contact you through the following methods:

    3.1 Phone Calls

    You consent to receive live, automated, pre-recorded, and AI-generated phone calls from Truck Driver Match, its employees, agents, affiliates, and carrier partners at any telephone number you provide. This includes calls made using automatic telephone dialing systems (ATDS), predictive dialers, and/or pre-recorded/artificial voice technology.

    3.2 Text Messages (SMS/MMS)

    By providing your phone number, you agree to receive SMS communications from Truck Driver Match regarding job opportunities, application status updates, recruitment information, and related services. Message frequency may vary. Standard Message and Data Rates may apply. Reply STOP to opt out at any time. Reply HELP for help.

    We will not share or sell your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages. Your mobile information will not be sold or shared with third parties for promotional or marketing purposes.

    3.3 Automated and Robocalls

    You expressly consent to receive autodialed calls, robocalls, and pre-recorded voice messages at the telephone number(s) you provide. You understand that these calls may be generated automatically and may not involve a live person at the time of connection. This consent covers calls for recruitment, job matching, follow-up, status updates, and informational purposes.

    3.4 AI-Powered Communications

    You acknowledge and consent that Truck Driver Match utilizes artificial intelligence (AI) technology in its communications, including but not limited to: (a) AI-powered chat conversations on our website; (b) AI-generated or AI-assisted phone calls; (c) AI-composed text messages and emails; (d) AI-generated voicemail messages; and (e) AI-facilitated recruitment interactions. You understand that you may be communicating with an AI system and that AI technology may be used to generate, compose, personalize, or facilitate any communication you receive from us.

    3.5 Email Communications

    You consent to receive email communications at any email address you provide, including job opportunity notifications, application status updates, recruitment-related information, newsletters, and promotional content.

    4. TCPA Consent and Compliance

    By providing your telephone number through our website, chat system, or any other channel, you provide your prior express written consent as required by the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and all applicable federal and state telecommunications laws, including but not limited to the CAN-SPAM Act, state mini-TCPA statutes, and FCC regulations. You agree that:

    • Your electronic submission of your telephone number constitutes your signed, written consent;
    • This consent is given knowingly and voluntarily;
    • This consent is not required as a condition of purchasing any goods or services;
    • This consent applies regardless of whether your telephone number appears on any federal, state, or company-specific Do-Not-Call registry;
    • You are the subscriber or customary user of the telephone number(s) provided;
    • You will notify us immediately if you cease to be the subscriber or customary user of any telephone number you provided.

    5. Voluntary Submission of Information

    You acknowledge and agree that any and all personal information submitted through our Services—including through our AI chat system, forms, phone conversations, text messages, emails, or any other communication channel—is provided voluntarily, knowingly, and of your own free will. You are under no obligation or compulsion to provide any information. Your decision to provide information constitutes your voluntary act and informed consent to the collection, use, and sharing of such information as described in these Terms and our Privacy Policy.

    6. Opt-Out and Revocation of Consent

    You may revoke your consent to receive communications at any time by:

    • Replying STOP to any text message to opt out of SMS communications. Reply HELP for help.
    • Pressing the opt-out option during any automated call
    • Clicking the unsubscribe link in any email
    • Contacting us directly at adam@driveracquisition.com
    • Sending a written request to revoke consent

    Please allow up to 10 business days for your opt-out request to be fully processed. Opting out of communications may limit our ability to provide job-matching services to you.

    7. Mobile Information & SMS Non-Sharing Policy

    We will not share or sell your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your Personal Data, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.     8. Recording and Monitoring

    You acknowledge and consent that all communications with Truck Driver Match, including chat conversations, phone calls, text messages, and emails, may be recorded, monitored, and/or stored for quality assurance, training, legal compliance, dispute resolution, and service improvement purposes. Chat transcripts with our AI system and human operators are automatically saved and may be reviewed.

    9. Third-Party Sharing

    By using our Services, you consent to the sharing of your personal information with our carrier partners, affiliated companies, and service providers for the purpose of job matching, recruitment, and communications. Carrier partners who receive your information may contact you directly regarding employment opportunities. Each carrier partner's use of your information is subject to their own privacy policies and terms. We do not sell your personal information to third parties for their own marketing or promotional purposes.

    10. Disclaimer of Guarantees

    Truck Driver Match does not guarantee employment, specific pay rates, job placement, or any particular outcome from using our Services. All job listings, pay ranges, and carrier information are provided for informational purposes and are subject to change. Actual employment terms are determined solely by the hiring carrier.

    11. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUCK DRIVER MATCH AND DRIVER ACQUISITION, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES ARISING FROM COMMUNICATIONS SENT OR RECEIVED, JOB MATCHING RESULTS, OR INTERACTIONS WITH CARRIER PARTNERS.

    12. Indemnification

    You agree to indemnify, defend, and hold harmless Truck Driver Match, Driver Acquisition, LLC, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising out of or related to: (a) your use of our Services; (b) your violation of these Terms; (c) your provision of inaccurate or misleading information; or (d) your violation of any third-party rights.

    13. Dispute Resolution and Arbitration

    Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our Services shall be resolved through binding individual arbitration, and you waive any right to participate in a class action lawsuit or class-wide arbitration. This arbitration agreement is governed by the Federal Arbitration Act. Either party may seek injunctive relief in a court of competent jurisdiction.

    14. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Driver Acquisition, LLC operates, without regard to conflict of law principles.

    15. Modifications to Terms

    We reserve the right to modify these Terms at any time. Changes will be posted on our website and are effective immediately upon posting. Your continued use of our Services after any modifications constitutes acceptance of the updated Terms.

    16. Severability

    If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
